The DS came out far before the iPhone, and other, less detailed touch screens were around before that... therefore, i dont think its neccesarily the touchscreen technology they're suing over, but rather components within the device that allow it to function; not the concept, but the things that help the concept work. Perhaps it doesnt even have to do with touch whatsoever, but rather something that makes it operate, or its charging mechanism. it could be a multitude of things.
