Both clearly states no flaming and flaming includes insulting other members. Yes, it is an insult if you call other people's work fail for no reason.
Sorry, but just because you don't care doesn't mean other people doesn't mind it other. It's called being considerate and having manners. Don't want to be nice? Then you will receive infractions if you continue to carry on this behaviour when commenting other people's work.
