I think I need a lawyer on retainer!

OMG! Reading the TOS makes me think I need a lawyer on retainer to interpret some of it.

Take for example:

Certain areas of the Outspark Service contain functionality related to the purchase and use of premium content, items and avatars (the "Premium Items") using a fictional currency ("SparkCash") that has no real world value. Regardless of any terminology used or any name freely given by Outspark to SparkCash, the terms and conditions related to SparkCash may change at any time without notice. The rights granted in the SparkCash and in the Premium Items are a limited license right available for one year from the data of purchase or less as specified or the case maybe. Outspark may charge fees for the right to use SparkCash.

First of all, they should fire their proofreaders and copy editors (blue text examples), but that aside - is the red text telling me that if I don't use the Dakkon Birthday suit I have in my premium bag before Dakkon's next birthday that it could be rendered unaccessable and there is nothing I could do about that?

i couldnt work out wat that blue "maybe" is suppose to be....

But at the same time.. Outspark's ToS has said that they're not held responsible for any Premium Items loss due to server down etc. But they still compensate us most of the time...

But that being said, i guess we cant make sure that they WILL ensure the stuff are still there after a year..... =/

I am pretty sure that they will never enforce those policies and the only reason they have them in there is because their lawyer was yelling at them to cover their own ass or close any loop holes that they have learned about from previous MMORPGs doing things like that.
