They need a warrant first, i believe. but, in the us, if they have one, they can. dunno about the great white north though.

Also, Jik, they don't have to have a warrant if they are arresting you.

In the US, the cops can ask to see your cell phone but can't take it without a warrant unless you're being arrested. At least as much as the caselaw that I've read. There are some grey areas concerning whether the phone is considered a closed container or part of the person...
