do not use the patch. these are just files from the outspark version of fiesta!

Such a patch could make the client unstable. And i doubt that it is allowed to copy files from the outspark client without permission.

Really don't think you should've done this. Shouldn't post modified files out in the open. If people in-game needed it you should've just given it to them personally through PM.

yes i have a degree in copyright and this is a breach copyright for both BK and Fiesta, yes they have their own copyright issues, they arent just the same game. you could be forgiven for thinking its the same game and that it was fine to interchange files, but editing any part of a game as its released is a breach of copyright. if it was under a opensource GPL it would be a different story. LOL. but like that would ever be the case for a game this awsome.

works for me :S and no the game isnt being modified since its just replacing files which is allowed

Actually, the copyright owners are Onsoft. Outspark merely licensed the game - but they do not hold any ownership whatsoever of the copyright itself.

The legality of moving files from one game to another is perfectly legal.

Copyright laws - if you really have a degree in law, you know only applies when the product in question is being sold, redistributed under another name, or redistributed without the consent of the copyright holder.

For the posting of the files here is, infact a violation of the copyright - however, moving the files yourself is perfectly legal.

Furthermore, if you wish to discuss about the legality of the situation here, is the End-User License Agreement. The one we agreed to before playing this game. That is the only real legal violation being made by the moving of files from one place to another.

Copyright does not offer protection from disassemination either (one thing frequently found wrong with all these newly graduated lawyers.) Again, that is an End-user license agreement.

Again, this does not fall under outsparks jurisdiction. It falls under the true copyright owners Onsoft. The only part outspark has to play in this is the end-user license agreement - so it can be questionable whether it is under outsparks jurisdiction depending on what was written in the agreement.

my degree is in information technology which has a certificate on copyright. sorry for not being more specific. I find it hard not to take offense at this, I thought this forum was different because people here respected each other and did not resort to name calling and puerile insults.

His point is that its all under the same copyright. Onsoft owns both versions, its the same game, Outspark just published the english version. Its like using one playstation 2s parts and putting it into another playstation 2, to fix the other one. Atleast thats how I see it.
